However, it still lacks to verify the especificidade in relation to the scientific institutions and technological public. The conceptual elements gifts in the private relations continue being valid, the questions are its economic applicability of these concepts, relations and the decurrent institucional implications of the technology transfer of a public being for a private one. In this way, the Law n 10,973, of 2 of December of 2004, that it makes use on incentives to the innovation and the scientific and technological research in the productive environment and that is known as the Law of the Innovation, as well as the Decree n 5,563, of 11 of October of 2005, regulates that it, gives an important step. This law establishes a new vision on the relations between knowledge and innovation and on the paper of the agents and instruments that are involucrados in these relations. Gestada in a context of integration of public politics, the Law of innovation intrinsically is related to the educational, industrial politics and technological of the Country. As it defines the Ministry of Science and Technology *, in its analysis of this normative one, this regulatory landmark is organized around three sources: ) the environment constitution I propitiate to the strategical partnerships between the technological universities, justinian codes and companies. b) I stimulate to the participation of institutions of science and technology in the innovation process, and c) incentive to the innovation in the company. The spirit of the law is to create a dynamic environment that stimulates the innovation. In this environment, the scientific and technological companies, government and justinian codes establish a synergic relation for that the knowledge produced in the universities and justinian codes if transforms into innovation (processes and/or products) in the companies and of this form, contributing still more for the industrial development of the Country. For this some mechanisms are foreseen in the Law: One of them is the possibility of the Union, the States, the Federal District, the Cities and the respective agencies of promotion to stimulate and to support the constitution of strategical alliances and the development of cooperation projects being involved national companies, Scientific Institution and Tecnolgica (ICT) and organizations of private law without lucrative ends come back toward activities of research and development, who objectify the innovative generation of products and processes.
